U.S. Supreme Court Decision Strikes Down Trump Administration’s Use of IEEPA Tariffs

On February 20, the Supreme Court of the United States issued a 6–3 decision holding that the Trump Administration may not rely on the International Emergency Economic Powers Act (IEEPA) to impose tariffs.

At this time, the implications for entry filing procedures remain unclear. Our colleagues on the NCBFAA Customs Committee are currently reviewing the ruling and will provide further guidance as it becomes available.
