US Supreme Court Delays IEEPA Tariff Decision

As reported by Chris Gillis, NCBFAA, on January 10, 2026, The U.S. Supreme Court was expected to release its decision on Friday, Jan. 9, related to two pending cases challenging the legality of the issuance of President Trump's IEEPA tariffs, but delayed the release. The court, which returned from its winter holiday on Jan. 9, could announce its IEEPA tariff decision early this week.

The two cases are Learning Resources, Inc. et al. v. Trump, President of U.S., et al. (No. 24-1287) and Trump, President of U.S., et al. v. V.O.S. Selections, Inc., et al. (No. 25-250). Oral arguments were presented before the Supreme Court justices on Nov. 5, 2025.

The Trump administration, meanwhile, has reportedly said it will use other means to implement tariffs if the Supreme Court decision should rule against its utilization of the IEEPA-based tariffs.
