CIT Opinion Vacates Both Trump Administration Reciprocal and Fentanyl Tariffs

The Court of International Trade (CIT) on Wednesday evening, May 28, issued its opinion in both V.O.S Selections Inc. et al v. Donald J. Trump et al: Court No. 25-66 and The State of Oregon et al v. Donald J. Trump et al: Court No 25-77 finding the IEEPA authorizes neither the reciprocal nor fentanyl tariffs. As such the court determined that the executive orders must be vacated and their operation permanently enjoined. The CIT will soon be issuing an order accordingly. The Trump administration is likely to seek a stay of the order and file an appeal to the Court of Appeals for the Federal Circuit (CAFC).
